The administration\u2019s move halted the ability of people from affected nations to obtain green cards, US citizenship, and other benefits.<\/p>\n<p>US District Judge John J. McConnell Jr., an appointee of former President Barack Obama, said in his  that the administration\u2019s policies are rooted in \u201canti-immigrant sentiments that it is forbidden from letting influence its decision-making\u201d and have placed immigrants living in the United States in \u201cindeterminate legal limbo.\u201d<\/p>\n<p>\u201cThe challenged policies placed the lives of countless individuals on hold \u2014 solely by virtue of their countries of birth,\u201d McConnell wrote. \u201cOver six months later, many of those individuals remain without work, without legal status, and without any meaningful ability to plan for their futures.\u201d<\/p>\n<p>\u201cThe government effectively invites the court to shut its eyes and ignore the strong evidence of anti-immigrant animus before it,\u201d the judge added. \u201cDoing so would require profound naivet\u00e9 on the court\u2019s part. Unfortunately for the government, that is an invitation that this court will have to decline.\u201d<\/p>\n<p>US Department of Homeland Security (DHS) General Counsel James Percival slammed McConnell\u2019s ruling in a social media post accusing \u201cthe Left\u201d of \u201crunning the same gambit with so-called \u2018animus\u2019 claims since 2017.\u201d<\/p>\n<p>\u201cIt is sabotage dressed in legal clothing,\u201d Percival added. \u201cIt goes like this: (1) the admin is racist, (2) therefore a policy I don\u2019t like is motivated by race, (3) therefore it is invalid. They have used it on virtually every Trump-era DHS policy.\u201d<\/p>\n<p>Plaintiffs and others involved in the case welcomed McConnell\u2019s decision.<\/p>\n<p>\u201cThis ruling reaffirms a basic principle: The federal government cannot shut down lawful immigration pathways or discriminate against people based on where they come from,\u201d Democracy Forward president and CEO Skye Perryman said in a statement.<\/p>\n<p>Read more <a href=\"https:\/\/smartmovinghome.com\/?p=348\">Families of Victims Who Died From Heat in Prison Fight to Prevent More Deaths<\/a><\/p>\n<p>\u201cThese unlawful policies caused enormous harm to families, workers, asylum seekers, and communities across the country who were left in limbo, unable to work, access protections, or move forward with their lives,\u201d Perryman added. \u201cWe are pleased that the court recognized the devastating human consequences of these policies. Our communities deserve a fair process governed by law, not political targeting rooted in fear-mongering and discrimination.\u201d<\/p>\n<p>Milagro Sique, CEO at the Dorcas International Institute of Rhode Island, said: \u201cToday is a good day. On behalf of the thousands of immigrants we serve, we are grateful to Judge McConnell for his ruling.\u201d<\/p>\n<p>\u201cThese policies were wrong, plain and simple, and caused profound fear and uncertainty for so many of our friends, neighbors, and coworkers,\u201d Sique added. \u201cHaving the judicial process work as intended \u2014 by upholding the rule of law \u2014 gives us some reassurance that all is not lost and allows those who have been impacted to move forward with their lives in a meaningful way.\u201d<\/p>\n<p>Abbey Koenning-Rutherford, staff attorney at Muslim Advocates, said that \u201ctoday\u2019s decision is an unsparing rejection of the government\u2019s discriminatory and unlawful actions to gut access to immigration benefits under the false pretext of national security.\u201d<\/p>\n<p>\u201cThese policies unjustly revived the discriminatory logic of the first Muslim and African bans and expanded them widely to millions of community members already inside the United States,\u201d she continued, referring to policies enacted during Trump\u2019s first term.<\/p>\n<p>\u201cIn vacating these unlawful policies, the court makes it unmistakably clear that the Trump administration cannot hold the lives of immigrants in legal limbo based on their countries of birth, and must continue processing their applications for status and benefits as required by law,\u201d Koenning-Rutherford added.<\/p>\n<p>Congresswoman Pramila Jayapal (D-Wash.) \u2014 an immigrant from India \u2014 was among the Democratic lawmakers who applauded Friday\u2019s ruling, writing on social media that \u201cthis is a BIG win.\u201d<\/p>\n<p>\u201cA judge has now reaffirmed that Trump\u2019s freeze on processing immigration applications for 39 countries is illegal and that processing must restart immediately,\u201d she added. \u201cToday\u2019s ruling is not the end of the fight, but it is a major step in the right direction.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/smartmovinghome.com\/?p=346\">Outrage Mounts at Assaults of Journalists and Hunger Strikers at Delaney Hall<\/a><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The ruling strikes down Trump\u2019s freeze on processing for immigrants from 39 countries, which left many in legal limbo.<\/p>\n","protected":false},"author":1,"featured_media":351,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-352","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-interesting"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
