The US Supreme Court on Monday cleared the way for the Trump administration to proceed with sweeping new restrictions on mail-in voting, removing a major legal obstacle just weeks before states begin sending ballots for the 2026 midterm elections and prompting two of the high court\u2019s liberal justices to warn that the ruling will sow \u201cchaos and uncertainty.\u201d<\/p>\n

Contrary to social media posts from supporters of President Donald Trump, the court\u2019s right-wing majority did not rule in that the president\u2019s March executive order directing several federal agencies to change how elections are administered is constitutional. Instead, the justices concluded in the 6-3 unsigned order that the states challenging the order had not demonstrated sufficient standing to sue at this stage and stayed a lower court injunction blocking its implementation.<\/p>\n

Monday\u2019s ruling came after the justices\u2019 June rejection of a Republican-backed challenge to state laws permitting election officials to count certain mail-in ballots that arrive after Election Day.<\/p>\n

\u201cThe court\u2019s disposition of this application does not mean that any measure taken by the government to implement the order will necessarily be lawful,\u201d the majority wrote in Monday\u2019s decision. \u201cOn that score, time will tell.\u201d<\/p>\n

That was little consolation to Justice Sonia Sotomayor, who penned a dissent joined by Justice Ketanji Brown Jackson.<\/p>\n

\u201cToday\u2019s decision does not address whether the president\u2019s attempts to interfere with states\u2019 administration of the November 2026 elections are lawful,\u201d Sotomayor wrote. Instead, the majority punted the matter even as states face a \u201cconcrete and imminent injury\u201d from Trump\u2019s executive order.<\/p>\n

\u201cThis ruling violates well-established precedents concerning this court\u2019s equitable discretion and needlessly injects chaos and uncertainty into the upcoming midterm elections,\u201d the dissenters asserted.<\/p>\n

Trump and Republicans have used fearmongering disinformation to amplify the nearly nonexistent \u201cthreat\u201d of voter fraud \u2014 especially in regard to mailed ballots \u2014 and noncitizens voting in US elections. This, even as Trump has repeatedly voted by mail.<\/p>\n

The Trump administration is trying to move control over key parts of federal election administration from the states to the federal government. The president\u2019s executive order instructs the Department of Homeland Security to create federally verified lists of citizens eligible to vote, requires states to provide voter information to the federal government, and directs United States Postal Service to condition delivery of mail ballots on compliance with its edicts.<\/p>\n

Twenty-three states and the District of Columbia sued, arguing that the president cannot unilaterally rewrite their election procedures \u2014 especially so close to the 2026 midterms \u2014 when the Constitution gives states primary responsibility for administering elections and grants Congress, not the executive branch, authority to set election rules.<\/p>\n

\u201cThis decision is a painful setback, but it will not be the final word,\u201d Democratic New York Attorney General Letitia James said in a statement. \u201cThe right to vote is sacred, and no administration should be allowed to put that right in jeopardy by making it harder for eligible voters to cast their ballots.\u201d<\/p>\n

\u201cThis fight is far from over,\u201d she added. \u201cWe are exploring our legal options.\u201d<\/p>\n

Democratic Association of Secretaries of State chair Cisco Aguilar of Nevada said that \u201ctoday\u2019s news is disappointing, but we will continue challenging this executive order and using every tool available to defend voting rights and the constitutional authority of states to administer elections.\u201d<\/p>\n

\u201cThe Supreme Court should protect those fundamental principles,\u201d Aguilar asserted. \u201cInstead, it has allowed a president to reshape the electorate for his own political benefit. Every Republican running for secretary of state should tell voters where they stand: Will they defend the people\u2019s right to choose their leaders, or support Donald Trump\u2019s attempt to choose which Americans get to vote?\u201d<\/p>\n

California Gov. Gavin Newsom, also a Democrat, said on social media: \u201cAnother day, another Trump attempt to rig elections and destroy democracy. We can stop this. VOTE this November.\u201d<\/p>\n

Senate Minority Leader Chuck Schumer (D-NY) said, \u201cIt\u2019s a disgrace that the highest court in the nation is allowing Trump to stab a dagger into the heart of our democracy.\u201d<\/p>\n

\u201cTrump\u2019s effort to turn the Postal Service into a voter suppression machine is blatantly unconstitutional \u2014 yet his MAGA Supreme Court is refusing to stop it from going forward,\u201d he added. \u201cTrump\u2019s malicious effort to stop mail-in voting is nothing but election interference in broad daylight. He wants to make it harder for Americans to vote so they don\u2019t hold him accountable for the skyrocketing costs, illegal war, and rampant corruption that are a hallmark of his administration.\u201d<\/p>\n

Sen. Alex Padilla (D-Calif.) posted on social media that \u201cTrump is desperately trying to rig the rules for the 2026 election.\u201d<\/p>\n

\u201cHe is rushing through an unconstitutional order to limit mail voting before the midterms and the Supreme Court isn\u2019t stopping him,\u201d the senator added. \u201cStates \u2014 not Trump \u2014 run our elections and the rule of law MUST be upheld. This fight is not over.\u201d<\/p>\n

Congresswoman Ayanna Pressley (D-Mass.) called the ruling \u201cshameful.\u201d<\/p>\n

\u201cWhile Donald Trump votes by mail, his allies on the Supreme Court are letting him take that right away from everyone else,\u201d she said. \u201cThis far-right majority court is once again complicit in Republicans\u2019 assault on our democracy.\u201d<\/p>\n

Virginia Kase Solom\u00f3n, president and CEO of the Washington, DC-based watchdog group Common Cause, issued a statement blasting Monday\u2019s decision as \u201can absolute outrage.\u201d<\/p>\n

\u201cVote-by-mail isn\u2019t a political bargaining chip \u2014 it is a vital lifeline for our seniors, service members, busy parents, rural voters, and voters with disabilities,\u201d she said. \u201cRestricting that right is an unacceptable, deliberate power grab designed to manufacture chaos and silence voters.\u201d<\/p>\n

\u201cThe Trump administration can try to override state laws and control our elections, but they do not get the final say \u2014 the people do,\u201d Kase Solom\u00f3n added. \u201cWe refuse to back down. Common Cause will continue to challenge any illegal attempt to limit vote-by-mail or nationalize elections.\u201d<\/p>\n

Trevor Potter, president of the Campaign Legal Center, a litigation and policy advocacy group, lamented \u201cyet another example of the highest court in the country granting the current administration undue latitude to engage in anti-democratic actions.\u201d<\/p>\n

\u201cHowever, this decision is purely about the timing of court challenges \u2014 not the merits of the president\u2019s case,\u201d Potter stressed. \u201cAmericans everywhere should know that the president still has no constitutional or legal power to change our election rules, nor does this ruling mean that his second executive order on voting will ultimately be held lawful by the courts.\u201d<\/p>\n

At the grassroots advocacy group Stand Up America, executive director Christina Harvey argued that \u201cthe Supreme Court should be putting limits on executive overreach, not helping Donald Trump push the boundaries of presidential power, undermine the Constitution, and disenfranchise voters.\u201d<\/p>\n

\u201cWith today\u2019s decision,\u201d she added, \u201cthe MAGA majority on the Supreme Court is bolstering Trump\u2019s scheme to protect his allies in Congress by taking over our elections and restricting how we exercise our freedom to vote.\u201d<\/p>\n
