Trump<\/em> is one of a series of youth-led climate change lawsuits brought by Our Children\u2019s Trust, an Oregon-based advocacy law firm, which also successfully litigated <em>Held v. Montana<\/em> in 2023, a landmark climate case that found the Montana Constitution guarantees the right to \u201ca clean and healthful\u201d environment. <\/p>\n<p>The plaintiffs in the Lighthiser case include young people from Montana, Oregon, Hawaii, California and Florida.<\/p>\n<p>The lawsuit was first argued before a federal judge in Missoula who \u201creluctantly\u201d dismissed the case.<\/p>\n<p>In June, a three-judge panel of the circuit court also rejected the lawsuit\u2019s arguments that three executive orders President Donald Trump signed early in his second term will accelerate human-caused climate change and harm the youth.<\/p>\n<p>A major sticking point for both the district and federal court judges was that the request by the youth \u2014 to roll back the executive orders and prevent any federal agencies from enforcing them \u2014 was an \u201cunprecedented\u201d ask and effectively challenged hundreds of existing and anticipated actions. <\/p>\n<p>Lawyers for the plaintiffs said the court was declining to look at the hard evidence that carbon dioxide emissions from the fossil fuel industry \u2014 bolstered in the executive orders \u2014 are closely linked to climate change and causing a \u201cchildren\u2019s health emergency.\u201d <\/p>\n<p>Read more <a href=\"https:\/\/smartmovinghome.com\/?p=1418\">Study: Medicare for All Would Save 114k Lives Yearly \u2014 And Save $1T in Costs<\/a><\/p>\n<p>\u201cIn this case, not a single government official even attempted to controvert that climate change is real, that it is rapidly changing our environment in the United States, and that it\u2019s responsible for causing a children\u2019s health emergency,\u201d said Dan Snyder, Director of Public Justice\u2019s Environmental Enforcement Project.<\/p>\n<p>The district court had agreed with the scientific arguments, but not the legal basis of the case, with federal district court Judge Dana Christensen saying the scope of the request from the 22 young people was \u201can unworkable request.\u201d<\/p>\n<p>\u201cNo circuit court in American history has ever said it lacked the power to review an unconstitutional executive order. Until this case,\u201d Julia Olson, Chief Legal Counsel and Co-Executive Director of Our Children\u2019s Trust, said in a statement. \u201cThe President cannot lawfully direct a sweeping fossil fuel agenda that endangers children\u2019s lives with no meaningful judicial check.\u201d<\/p>\n<p>Montana, which lost a constitutional challenge from youth plaintiffs \u2014 <em>Held v. Montana<\/em> \u2014 in 2024, intervened in the case, with lawyers from the attorney general\u2019s office taking part in both the district and circuit court arguments. <\/p>\n<p>\u201cThe court\u2019s rejection confirms what we\u2019ve said all along, that this case was never about the law, but an attempt to block President Trump\u2019s pro-energy policies and force a liberal climate agenda,\u201d Montana Attorney General Austin Knudsen said in a statement. \u201cThe court got it right by refusing to rehear a case that was already correctly decided.\u201d <\/p>\n<p>The challenged orders included Trump Executive Orders 14154, \u201cUnleashing American Energy;\u201d 14156, \u201cDeclaring a National Energy Emergency;\u201d and 14261, \u201cReinvigorating America\u2019s Beautiful Clean Coal Industry.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/smartmovinghome.com\/?p=1417\">White House Reportedly Lobbied to Keep Accused Abuser Rep.
