Lawyers for the Department of Justice (DOJ) dropped subpoenas of several New York Times <\/em>journalists \u2014 and some targeting their family members \u2014 after a federal judge berated the Trump administration for its actions.<\/p>\n

Earlier this month, the Times <\/em>reported on security flaws of President Donald Trump\u2019s new Qatari-gifted Air Force One jet. When Trump didn\u2019t use the jet on his travels home from a NATO conference in Turkey, he had insisted that it was being diverted in order to show it off to soldiers stationed in Europe. <\/p>\n

But the Times <\/em>reported early this month that Trump didn\u2019t use the newer jet because it had multiple security flaws. The report cited numerous individuals within the Trump administration who spoke anonymously about the subject. <\/p>\n

Later in July, the paper was alerted to the fact that its journalists\u2019 phone records had been subpoenaed by the administration to root out who the sources were. In addition to those journalists\u2019 records, the White House also sought the phone data of their family members, including journalists\u2019 spouses and parents. <\/p>\n

The subpoena requests dated all the way back to January of this year \u2014 suggesting that \u201cthe department is using this investigation not to focus on any purported concerns arising from the July 8 and 9 articles, but instead to forage for information about the journalists\u2019 source relationships more broadly,\u201d the papers\u2019 lawyers noted in a recent court filing. <\/p>\n

On Thursday afternoon, during a court hearing regarding the case, lawyers for the Trump administration said they were dropping the subpoenas. <\/p>\n

\u201cThe government is prepared to unilaterally withdraw the subpoenas at this time,\u201d chief counsel for the DOJ Sean Buckley told the court.<\/p>\n

A spokesperson for the department indicated that the case was ongoing. \u201cWe will pursue justice against those threatening national security by leaking classified information,\u201d the spokesperson said. <\/p>\n

During the hearing, Judge Arun Subramanian berated the federal lawyers, noting that the subpoenas represent \u201cthe last thing you do\u201d to journalists in leak investigations.<\/p>\n

\u201cIt\u2019s a matter of basic compliance with the law,\u201d Subramanian added. <\/p>\n

The DOJ\u2019s lawyers tried to insist that their actions \u2014 including subpoenaing journalists\u2019 family members\u2019 records \u2014 were mistakes. <\/p>\n

\u201cThat was an error. We own it,\u201d Buckley said. \u201cWe used a public source database\u201d to determine who to subpoena.<\/p>\n

Subramanian expressed impatience with the Trump administration\u2019s excuses.<\/p>\n

\u201cThe inadvertent errors and the \u2018in hindsight we should have done things differently,\u2019 these things are piling up,\u201d he said. <\/p>\n

\u201cAre you going to do this again?\u201d Subramanian asked the DOJ lawyers. <\/p>\n

They indicated that they wouldn\u2019t. However, given Trump\u2019s hostility toward journalists and the media, Subramanian\u2019s skepticism appears to be warranted.<\/p>\n
